Terms of Sale – Allergia
1. Purpose of the Terms of Sale
These Terms of Sale define the conditions for subscription, use, renewal, and cancellation of Premium offers proposed within the Allergia mobile application.
Any subscription to a Premium offer implies full acceptance of these Terms of Sale.
2. Seller
Premium offers are marketed under the trade name Allergia.
The seller’s full contact details appear in the Legal Notice available from the website and the application.

3. Description of Offers
Allergia offers a free version as well as Premium features available by subscription.
Premium features may evolve as the application is updated.
The list of Premium features displayed in the application at the time of subscription shall prevail.
4. Pricing
The applicable prices are those displayed in the application at the time of subscription.
Prices are displayed in the user’s country currency when the Apple App Store or Google Play Store platforms apply local conversion.
Prices may be modified at any time for new subscriptions. Price changes concerning existing subscriptions are managed in accordance with the applicable rules of the relevant distribution platforms.
5. Subscription Process
Subscriptions are made exclusively through the Apple App Store or Google Play Store.
The sales contract is concluded when the purchase is validated by the relevant platform.
The user acknowledges that they are responsible for checking the information displayed before validating their purchase.
6. Payment
Payments are fully processed by Apple for iOS devices and by Google for Android devices.
Allergia does not collect or retain users’ bank details.
Payment terms are those defined by the conditions of the relevant platforms.
7. Service Activation
Access to Premium features is generally activated immediately after confirmation of purchase by the relevant platform.
Exceptional technical delays independent of the publisher may nevertheless occur.
8. Automatic Renewal
Unless cancelled by the user, subscriptions are automatically renewed at the end of each billing period.
Automatic renewal is managed exclusively by the Apple App Store or Google Play Store.
The user may check the status of their subscription at any time from their Apple or Google account.
9. Cancellation
The user may cancel their subscription at any time from their Apple ID settings on iPhone or iPad, or from Google Play Store on Android.
Cancellation takes effect at the end of the subscription period already paid for.
No prorated refund is made by Allergia.
10. Restoring Purchases
In the event of a device change or application reinstallation, the user may restore their purchases according to the mechanisms provided by the Apple App Store or Google Play Store.
Availability of this feature depends on the services provided by the relevant platforms.
11. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the user acknowledges and accepts that performance of the service begins immediately after validation of their purchase.
By validating their subscription, the user requests immediate performance of the service and expressly waives their right of withdrawal for digital content supplied immediately.
This provision applies within the limits authorized by applicable regulations.
12. Refunds
Any refunds are subject to the rules of the Apple App Store and Google Play Store distribution platforms.
Refund requests must be addressed directly to the platform that processed the payment.
The publisher cannot guarantee that these platforms will accept a refund request.
13. Service Evolution
The publisher may evolve the application’s features, in particular to improve service quality, correct anomalies, meet legal or regulatory requirements, and add or modify certain features.
These changes do not constitute a substantial modification of the contract where they do not result in the unjustified removal of the main features of the Premium service.
14. Suspension or Interruption
Access to Premium features may be temporarily suspended in particular in the event of maintenance operations, technical incidents, unavailability of a third-party service, or force majeure.
The publisher makes efforts to limit such interruptions but cannot guarantee permanent availability of the service.
15. Liability Relating to Premium Offers
The Premium subscription improves the features available in the application but does not constitute in any way a guarantee of absence of errors in the data consulted, absence of errors in third-party databases, exhaustive identification of allergens, or permanent availability of the service.
The user remains responsible for checking the information appearing on the packaging of the products consumed.
16. Consumer Mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer may use a consumer mediation mechanism free of charge to try to resolve a dispute.
The competent mediator remains to be completed after membership.
The mediator’s full contact details will be indicated once the mediation mechanism applicable to the activity has been set up.
17. Complaints
Any complaint relating to Premium services may be sent to contact@allergia.fr.
The publisher will make efforts to respond within a reasonable time.
18. Personal Data Protection
Personal data processing carried out as part of the service is described in the Privacy Policy available from the application and the website.
19. Applicable Law
These Terms of Sale are governed by French law.
Any dispute will be handled in accordance with the legal provisions applicable to contracts concluded with consumers.
20. Entry into Force
These Terms of Sale enter into force upon publication in the application and on the Allergia website.
