Terms of Use – Allergia
1. Purpose
These Terms of Use define the conditions for accessing and using the Allergia mobile application.
Allergia is an application intended to help users identify the potential presence of allergens in food products based on information available in the databases queried by the application.
Use of the application implies full acceptance of these Terms of Use.
2. Application Publisher
The application is operated under the trade name Allergia.
The publisher’s full contact details appear in the Legal Notice available from the website and the application.
3. Service Description
The application may in particular allow:
- reading food product barcodes;
- consulting information from external databases;
- comparing identified ingredients with allergens entered by the user;
- displaying alerts intended to help identify potential risks;
- managing allergen profiles;
- consulting a local scan history;
- reporting products missing from the databases used by the application.
Certain features may be reserved for users with a Premium subscription.
4. Informational Nature of the Service
Allergia is a tool designed to assist with reading ingredients.
The information provided does not constitute medical advice, does not constitute a medical diagnosis, does not replace reading the official product label, and does not replace recommendations from a healthcare professional.
The user remains solely responsible for their food decisions.
Before any consumption, the user must check the information appearing on the packaging of the relevant product.
5. Data Sources
The information analyzed by the application may come in particular from:
- public databases;
- data provided by third parties;
- reports made by users;
- processing performed locally by the application.
The publisher does not guarantee the absolute accuracy of the information, the absence of errors or omissions, the immediate updating of data, or the permanent availability of external sources.
6. Access Conditions
The application is accessible from compatible devices supported by the versions published on the official platforms.
Certain features require Internet access, permission to use the camera, and permission to access the features necessary for operation of the service.
Refusal of certain permissions may limit certain features.
7. Profile Creation and Management
The user may create one or more profiles in order to enter the allergens to be taken into account when analyzing products.
The user is solely responsible for the accuracy of the information they enter.
Profiles and associated allergens are stored locally on the user’s device, unless otherwise stated in the Privacy Policy.
8. Scan History
The application may offer a history of scanned products.
This history is intended to make the application easier to use.
The user may delete this history according to the features available in the application.
9. Product Reports
The user may voluntarily report a missing or incomplete product.
In this context, they undertake to transmit only accurate, lawful, and useful information for processing the report.
The publisher reserves the right not to process an incomplete, manifestly erroneous, or abusive report.
10. Advertising
The free version of the application may display advertisements.
The conditions relating to advertisements, possible personalization, and associated consents are detailed in the Privacy Policy.
The user may access a Premium version when available in order to benefit from the features associated with paid offers.
11. Premium Features
Certain features may be offered as part of a Premium subscription.
The sale, payment, renewal, cancellation, and refund conditions are detailed in the Terms of Sale.
12. Service Availability
The publisher makes efforts to ensure the proper operation of the application.
However, access to the service may be interrupted or limited in particular in the event of maintenance, updates, technical incidents, unavailability of a third-party service, or force majeure.
The publisher does not guarantee continuous and permanent availability of the application.
13. Intellectual Property
The Allergia application, its name, logo, interface, texts, graphic elements, features, and software developments are protected by applicable intellectual property rules.
Any unauthorized reproduction, representation, modification, distribution, or use is prohibited.
14. Prohibited Conduct
The user is prohibited in particular from diverting the application from its purpose, attempting to fraudulently access systems, transmitting unlawful or misleading content, disrupting operation of the service, or using the application in a way that infringes third-party rights or applicable regulations.
15. Liability
The publisher cannot be held liable for consequences resulting from a misinterpretation of the information displayed, an error in the databases queried, a failure to update information, use of the application contrary to these Terms of Use, or a food decision made by the user.
The user acknowledges that the application is an aid tool and not a guarantee of absence of allergy risk.
16. Personal Data Protection
The conditions governing the collection, use, and retention of personal data are described in the Privacy Policy available from the website and the application.
17. Modification of the Terms of Use
The publisher may modify these Terms of Use to reflect changes in the application, regulations, or services offered.
The applicable Terms of Use are those in force at the time the application is used.
18. Applicable Law
These Terms of Use are governed by French law.
In the event of a dispute, the parties will make efforts to seek an amicable solution before any legal action.
